What's new?

RENTAL EVICTION BILL SIGNED INTO LAW

 

What is the fundamental issue?

S. 896, the “Helping Families Save Their Homes Act of 2009” included some provisions to protect tenants from eviction as a consequence of a foreclosure affecting the property being rented. Many examples were seen of families living in rental housing throughout the United States who were evicted without any prior notice when the home where they had lived was foreclosed upon. Much of the time, the rental family had no idea the home was in delinquency or subject to foreclosure until their eviction.

 

I'm a Realtor®. What does this mean to my business?

Notification will have to be provided to tenants of rental housing before they can be evicted following a foreclosure.

 

NAR Policy:

NAR supports programs to reduce the impact of foreclosure on communities.

 

Legislative/Regulatory Status/Outlook:

Under the new law, which went into effect on May 20th, tenants will have to receive 90-days notice prior to being evicted, when their rental home is foreclosed upon. In addition, tenants must be allowed to stay in the property through the end of their lease, with two exceptions:

* The new owner wants to occupy the property as a personal residence, and
* There is no lease (month to month), or there is a lease but state law allows the lease to be terminated at any time upon notice.

Even under these exceptions, the tenants must be given 90-days before they can be evicted. Notification must be provided by the “immediate successor in interest”. In some cases, this notification will come from the bank (when they assume the home), and in other cases it may be the new owner. Much will depend upon state law.

A number of states have existing laws protecting tenants. This law will preempt existing state law, except where the state law offers greater protection.

The protections of this law apply only to “bona fide” tenants – who have a written contract, the lease was the result of an arms-length transaction, and the rent is not substantially less than the fair market rent for the property. Under any conditions, tenants may still be evicted if they violate the lease terms.
These provisions expire on December 31, 2012.

UPDATE FROM CITY OF FLAGSTAFF - ROGER EASTMAN, ZONING CODE ADMINISTRATOR

Here are a few quick updates regarding the Focus Groups for the zoning code project that are in response to queries we have received from Focus Group members and Flagstaff residents.

1.  The current Land Development Code (LDC) is available online at (see below). We are also in the process of printing updatedcopies of the LDC which will be available for review at the public library branches (downtown and East side). You may also pick up a CD of  the LDC from the Community Development front counter for a nominal fee.  http://www.flagstaff.az.gov/index.aspx?nid=779

2.   The zoning code webpage is frequently being updated with notes from  the Focus Group meetings and updates on future meetings, so please don't forget to visit it periodically to learn about recent developments   and on-going activities.http://www.flagstaff.az.gov\zoningupdate

3.    Attached are two documents that we hope will be of interest and use to you. The first is a summary of the Vision 20/20 document that back in 2000 or so helped to guide the vision and direction of the Regional Plan. The second document is a summary of the visions, goals and objectives of the Regional Plan.

4.     A final document that may be of interest to you may be accessed by using the urrl provided below. This is the DRAFT Sustainable Community Development Code that is being published on-line by the Rocky Mountain Institute in collaboration with Clarion Associates. MESSAGE FROM NAR GOVERNMENT AFFAIRS

The overwhelming number of comments and questions generated by the House of Representatives passing the
American Clean Energy and Security Act requires additional information to address the issue with members.  Attached is an NAR Info Pack that you can post on your websites and distribute to
members.

Here are the Legislative Facts:

Does not create a federal energy audit requirement for real property

Exempts existing homes and building from any federal guidelines for new construction energy efficiency information labels.

Prohibits the implementation of any labeling during a sales transaction.

NAR successfully argued  that  point of sale labels would have stigmatized existing property and complicated transaction

Leaves the decision to states as to whether to require energy audits, disclosures, etc.

Provides property owners with significant financial incentives, matching grants and tools to make property improvements and reduce their energy bills;

Prohibits the Environmental Protection Agency from regulating residential and commercial buildings under the Clean Air Act

Eliminated an early proposal to allow citizens to sue over minor climate risks under the Clean Air Act; and

Establishes green building incentives for HUD housing, including a loan program for renewable energy, block grants and credit for upgrades in mortgage underwriting.

The bill has passed only the House.  It is NOT LAW and NAR is working closely with the Senate to make additional improvements

In addition to our Land Use and Environment Committee consideration of this issue, NAR has been engaged since the appointment of a Presidential Advisory Group in Summer 2008

They met during 4 separate meetings  and heard expert testimony regarding the full range of Climate/Energy Issues

The PAG developed NAR's Climate Change Principles

During the November 2008 convention the Land Use and Environment Committee and the NAR Board of Directors approved the PAG recommendation

Meetings, via conference call, with the leadership of the Land Use Committee and Forum, as well as with former PAG members and half dozen Realtor associations that had addressed climate bills at the state level continued in early 2009 in anticipation of an Energy Bill. 

The consensus of all these groups was to concentrate on the real estate provisions -- especially energy labeling.
